Car Parks Terms and Conditions

DRIVE UP PARKING

If you arrive at the airport seeking parking, without a valid online booking, the Contractual Terms and Conditions of Entry apply. The Contractual Terms and Conditions of Entry apply to both drive up and valet parking, and are displayed at the entrance to all Sydney Airport car parks.


PRE-BOOKED PARKING

The terms and conditions set out below apply to you if you pre-book parking online.  These terms and conditions are structured as follows:
General Terms and Conditions:  clauses 1 to 20 apply to you if you pre-book parking online for any Sydney Airport car park.
Pre-booked self park:  in addition to the General Terms and Conditions, clauses 21 to 43 apply to you if you pre-book parking online for your nominated booking period and park your car yourself.  
Pre-booked valet:  in addition to the General Terms and Conditions, clauses 44 to 73 apply if you pre-book valet parking online for your nominated booking period.


GENERAL TERMS AND CONDITIONS

These terms apply to you if you pre-book parking online for any Sydney Airport car park.

  1. By entering and remaining in one of the car parks listed in clause 4 below, you enter into a contract with Sydney Airport Corporation Limited (ABN 62 082 578 809) upon these terms and conditions.  If you do not accept these terms and conditions, you must not enter the car park, or, if you can not turn around then you may enter the car park but you must exit immediately.
  2. In these terms, ’you’ or ’your’ refers to any person who makes a booking via the above website and ’we’ or ’us’ refers to Sydney Airport Corporation Limited and its contractors and agents.
  3. Certain aspects of our car parks and associated services are managed and operated by our agents.  All rights conferred upon us in these terms and conditions can be exercised by us or our agents. 
  4. These terms and conditions apply to the car parking services made available in the following locations:
    1. the parking precinct located at Terminal 1.  This precinct includes both undercover and open air parking.  We cannot guarantee that undercover parking will be available for you;
    2. the parking precinct located at Terminals 2 and 3.  This precinct includes both undercover and open air parking.  We cannot guarantee that undercover parking will be available for you;
    3. the Blu Emu parking precinct located at Ross Smith Avenue, Mascot.  This precinct includes a limited number of shaded parks and open air parking.  Shaded parking incurs an additional cost and we cannot guarantee that shaded parking will be available for you.  Persons parking at the Blu Emu parking area will be transported to Terminal 2 or 3 via shuttle; and
    4. valet parking services including the Pronto Valet parking service which is available at Terminals 1 and 2 and the Premium Parking service, which is available at Terminal 2.
  5. These terms and conditions contain important information and they specify those matters for which we do not accept responsibility or liability.
  6. While we use reasonable endeavours to ensure that car parks are secure, we do not guarantee that they are a secure environment.  The CCTV cameras installed in and around the parking precincts or structures are for the use and protection of Sydney Airport only and are not for the purpose of monitoring vehicles.  

Parking Fees

  1. Parking fees are charged on a per calendar day basis. If you plan to park across two separate calendar days, you will be charged for two calendar days, even if your stay was less than 48 or 24 hours in duration.

Limitation of liability

  1. To the fullest extent permitted by law, including the Australian Consumer Law which is Schedule 2 to the Competition and Consumer Act 2010 (Cth), we exclude our liability to you.  However, nothing in this agreement purports to modify or exclude the consumer guarantees and other legal rights under the Competition and Consumer Act 2010 (Cth). 
  2. You agree that your use of this car park is at your own risk.  To the extent permitted by law, we do not accept liability for:
    1. damage to your vehicle (whether caused accidentally or by way of vandalism); or
    2. theft of, or from, your vehicle, while the vehicle is in the car park, unless such damage or theft is caused by us breaching the consumer guarantees in the Australian Consumer Law.
  3. Any and all other warranties or conditions which are not guaranteed by the Australian Consumer Law or the Competition and Consumer Regulation 2010 (Cth) are expressly excluded where permitted, including liability for incidental or consequential damages caused by the breach of any express or implied warranty or condition or negligence.
  4. Our liability for failure to comply with a consumer guarantee under the Australian Consumer Law is limited to:
    1. in the case of goods other than goods of a kind ordinarily acquired for personal, domestic or household use or consumption: (1) the replacement of the goods or the supply of equivalent goods; (2) the repair of the goods; (3) the payment of the cost of replacing the goods or acquiring equivalent goods; or (4) the payment of the cost of having the goods repaired.
    2. in the case of services other than services of a kind ordinarily acquired for personal, domestic or household use or consumption: (1) the supplying of the services again; or (2) the payment of the cost of having the services supplied again.

Safety and security

  1. The Australian Road Rules and the Airports (Control of On-Airport Activities) Regulations 1997 apply and are enforced at Sydney Airport and you must comply with these rules and regulations as amended from time to time. Fines are payable by you for non-compliance. See Airports (Control of On-Airport Activities) Regulations 1997
  2. You must:
    1. drive carefully and responsibly in the car park;
    2. obey speed limits in the car park as signed;
    3. park only in designated public parking bays and not park in any area which is not a designated public parking bay;
    4. not enter public free parking zones if you are conducting commercial activities, including but not limited to TV plated vehicles and courtesy buses;
    5. not cause any obstructions, including parking across more than one bay;
    6. not park in a disabled bay without displaying a current disability permit;
    7. comply with all parking signs, permit zones and directions issued to you by us or our representatives; and
    8. comply with all laws and requirements relating to safety and security.
  3. If you fail to comply with clause 13(c) by parking across more than one bay so that no other vehicle has reasonable opportunity to park in that bay, you must pay an additional amount equivalent to two times the fee that would be payable by you if clause 13(c) were not breached.
  4. We, our agents or its representatives may enter, move or tow away your vehicle for operational, safety or security reasons.
  5. If we have to tow your vehicle as a result of your breach of these terms and conditions, you must pay our reasonable costs for towing, and storage of your vehicle, and any recovery costs, if applicable.

Indemnity

  1. You agree to indemnify us against any loss or damage we may suffer arising out of your negligence or breach of these terms and conditions.

General

  1. We must comply with the Privacy Laws.  Any personal information provided to us will be dealt with in accordance with our Privacy Policy.
  2. This agreement is governed by the laws of New South Wales.
  3. You must leave an appropriate amount of time to reach the terminal building from the car park or valet drop off zone.  You should factor in time to find a space, taking into account that the car park may be busy, particularly at peak times, get your luggage out of the car, lock the car, walk to the relevant shuttle stop and the shuttle journey to the airport (if parking in the Blu Emu car park) and walk to the terminal.  We do not accept responsibility if you miss your flight or your airline check-in has closed because you have not left enough time to get into the car park and then from the car park to the terminal.

Pre-booked self park (online booking only)

This section sets out the additional terms and conditions under which we agree to provide you with self parking using Sydney Airport’s online booking service, including when you use the online booking service to take advantage of a car park promotion.  If you do not agree to comply with these terms and conditions please do not make an online booking.

  1. You must have pre-paid the applicable fee for your use of the car park using the online booking process and your booking must have been confirmed by Sydney Airport as set out in clauses 26 to 37.
  2. If your exit date is uncertain, we recommend you consider pre-booking additional days. Extra days or hours stayed outside of your pre-booked nominated booking period will be charged at the standard rates displayed at the entry to the car park in which you stay.  
  3. When you have parked your vehicle, it is your sole responsibility to:
    1. lock your vehicle securely;
    2. fully close all windows of your vehicle;
    3. apply your handbrake properly;
    4. engage any steering lock, alarm or immobiliser you may have;
    5. not leave any animal or person within your vehicle; and
    6. ensure that your possessions are placed in a locked boot and are not on display.

We are not responsible for any loss or damage whatsoever occurring to your vehicle or possessions within it resulting from your failure to do these things.  We and our subcontractors do not accept any valuables or other articles for safe custody.  

  1. We may not permit your vehicle to exit the car park until:
    1. where available, a valid parking ticket is presented to the attendant;
    2. a valid parking ticket is accepted by an exit payment machine; or
    3. you provide acceptable evidence of ownership or entitlement to use the vehicle and pay the applicable fee for tickets that are misplaced or otherwise lost in circumstances where you misplace the parking ticket issued to you on entry.
  2. Size and height restrictions apply at some of our car parks.  You are responsible for ensuring that your vehicle complies with these restrictions.  Details of these restrictions are set out on the information page for each car park at www.sydneyairport.com.au/go/car-parking.aspx.

Your online booking

  1. The applicable fees are those parking fees, booking fees and credit card fees notified to you as applicable to your booking.
  2. A booking is confirmed only when you receive a booking receipt via the Sydney Airport website.  A copy will also be emailed to your nominated email address.
  3. Bookings are valid for one entry and one exit only. Multiple entries are not permitted.
  4. Bookings are only valid at the parking location chosen by you during the booking process.  An online self park booking will not be valid if you park using a valet service.  

Online booking Promotions

From time to time, we may make available certain promotions which apply to bookings made online.  The terms of any such promotions are incorporated into the terms of this agreement and the following additional terms will apply to any promotional online booking:

  1. You must make a booking using the online booking service to be eligible for the promotion.
  2. The promotional price is only available at the parking location and for the kind of service set out in the promotion’s terms.
  3. The promotion will only be offered for the period set out in the promotion terms.
  4. The availability of any promotion is subject to availability of car spaces.  Once the allocated promotional spaces are exhausted, that promotion will no longer be available.
  5. As with all online bookings, any unused portion of a promotional booking will not be refunded.
  6. Promotional offers cannot be used in conjunction with any other offers.
  7. Promotional offers often require you to make an online booking a certain period in advance of your booking date and time.  The promotion will only be offered if you book within that stated period.

What you must do

  1. You agree that:
    1. you must pay the applicable fee using an acceptable credit card;
    2. you will not attempt to enter the car park prior to the entry date and time nominated in your booking.  If you enter the car park prior to your nominated car park entry date and time, your booking is not valid and you will be charged again for your parking stay at standard rates displayed at the entry to the car park;
    3. if you stay for a period after the end of the exit date and time nominated in your booking then you must pay the applicable fee for the additional time.  The applicable fee for additional time will be calculated at the rates specified at the entrance to the car park you have used.  Fees apply based on the duration of stay past your booking end date and time.  For example, if you book for 3 calendar days but stay 5 calendar days, you have stayed an additional 2 calendar days and will be charged the standard rate for a 2 calendar day stay as signposted at the car park entrance;
    4. if the credit card payment used for your online booking fails then your online booking will not be processed;
    5. you must either:
      1. bring your booking receipt with you and scan the barcode on the receipt at the entry gate; or
      2. bring the credit card that you nominated to use for entry at time of booking and insert it into the credit card reader at the entry gate.  If you do not bring your booking receipt, or the credit card nominated to use for entry at the time of booking, we may require you to pay for the parking used at the rates specified at the entrance to the car park you have used.
    6. your booking must only be used by you or someone authorised by you; and
    7. you are not entitled to any refund if your vehicle does not comply with size and height restrictions.

What we must do

  1. We agree that:
    1. we must use reasonable endeavours to ensure that a space is available at the car park nominated in your booking;
    2. if a space is not available at the car park nominated in the booking, then we must use reasonable endeavours to accommodate your parking needs in accordance with the following procedure:
      1. if all spaces are full in your nominated cark park precinct, then you may park in any other precinct listed in clause 4;
      2. if all of our car parks are full or we are otherwise unable to accommodate your vehicle at any of our car parks, then:
        1. we will make efforts to organise alternative arrangements to accommodate your vehicle at no additional cost to you; or
        2. we will provide you with a refund of the applicable fee (excluding any non refundable fees) unless you purchased your booking from any person other than Sydney Airport.

Refunds and cancellations

  1. If you purchased your booking from any person other than Sydney Airport (such as a Sydney Airport authorised reseller) and you require a refund or cancellation, you must seek that refund or cancellation from that other person.
  2. You are only entitled to a refund from Sydney Airport where:
    1. you paid for your booking using your own credit card; and
    2. you effectively cancel a booking 24 hours or more prior to the start of the booking period; or
    3. we are unable to accommodate your vehicle in accordance with clause 38(b) of this agreement.
  3. For the avoidance of doubt:
    1. where you are entitled to a refund, that refund will be paid electronically into a bank account nominated by you;
    2. you are not entitled to a refund from Sydney Airport if you do not use the whole or part of the nominated period that you booked, including valet services;
    3. you are not entitled to a refund if you park in a car park precinct other than that set out in your booking (except for in accordance with clause 38(b)); and
    4. any payments made are forfeit and a refund is not available where you fail to cancel a booking 24 hours or more prior to the start of the booking period.
  4. Cancellation is only effective where:
    1. you log in to your Sydney Airport online booking account and successfully cancel your booking.  Your account may be accessed at https://prebook.sydneyairport.com.au/; or
    2. if you are unable to successfully cancel your booking via your online booking account, you notify us by email at book@syd.com.au 24 hours or more prior to the start of the booking period.  Your email must set out your full name, contact number, booking invoice number, booking period and the details as to why you could not log in to your online booking account to complete the cancellation.  Never send credit card details via email. Sydney Airport may in its discretion determine whether to apply a refund.  Refunds are not guaranteed.
  5. Non refundable fees including but not limited to, credit card fees, booking fees and any other fees notified to you as non refundable, are non refundable.

Pre-booked Valet parking (online booking only)

General terms and conditions

If you choose to use Pronto or Premium valet parking, and pre-book this service online the following additional terms and conditions apply and we will only accept your vehicle on the following terms and conditions:

  1. The person presenting this vehicle to us represents and warrants that such person is the owner or authorised controller of the vehicle and agrees to be bound by the terms and conditions.
  2. We do not agree to accept any goods for safe custody and do not accept responsibility for the same.
  3. When you have parked your vehicle at the relevant valet drop-off area, it is your responsibility to:
    1. lock your vehicle securely (but leave the key with us);
    2. fully close all windows of your vehicle;
    3. apply your handbrake properly;
    4. not leave any animal or person within your vehicle;
    5. ensure that your possessions are placed in a locked boot and are not on display; and
    6. comply with all relevant aviation security laws and follow the directions of Sydney Airport representatives and signage relating to issues of aviation security. The public are permitted to leave their vehicles unattended in the Valet Area provided they comply with certain security conditions of entry.
  4. We may move and drive the vehicle to such places as we deem appropriate during any period of custody, retention or control.
  5. We may deliver the vehicle to any person:
    1. producing the customer claim check; or
    2. offering such other evidence of ownership or authority or entitlement to receive the vehicle as we deems satisfactory.
  6. We may retain the vehicle until the customer claim check is produced or a person offers such other evidence of ownership or authority or entitlement to receive the vehicle as we deem satisfactory.
  7. We shall have a general lien upon the vehicle and its contents until all sums due for parking and/or other services rendered by us have been paid.
  8. Parking charges will be payable in respect of any period of retention and we reserve the right not to deliver the vehicle in accordance with clause 50 above until such charges are paid in full.
  9. We do not accept responsibility for theft of or from your vehicle unless you have entrusted the keys of the car to us and then only provided that the keys have been used in order to carry out the theft.  
  10. You must have pre-paid the applicable fee for your use of the car park using the online booking process and your booking must have been confirmed by Sydney Airport.
  11. If your exit date is uncertain, we recommend you pre-book additional days. Extra days or hours stayed outside of your nominated booking period will be charged at the standard rates displayed at the entry to the car park in which you stay.
  12. Size and height restrictions apply at some of our car parks.  You are responsible for ensuring that your vehicle complies with these restrictions.  Details of these restrictions are set out on the information page for each car park at www.sydneyairport.com.au/go/car-parking.aspx.

Your online booking

    7. you are not entitled to any refund if your vehicle does not comply with size and height restrictions.

Refunds and cancellations & Pre-booked Administration Fee

  1. If you purchased your booking from any person other than Sydney Airport (such as a Sydney Airport authorised reseller) and you require a refund or cancellation, you must seek that refund or cancellation from that other person.
  2. You are only entitled to a refund from Sydney Airport where:
    1. you paid for your booking using your own credit card; or
    2. you effectively cancel a booking 24 hours or more prior to the start of the booking period.
  3. For the avoidance of doubt:
    1. where you are entitled to a refund, that refund will only be provided to you on the card on which the booking was charged;
    2. you are not entitled to a refund from Sydney Airport if you do not use the whole or part of the nominated period that you booked, including valet services;
    3. any payments made are forfeit and a refund is not available where you fail to cancel a booking 24 hours or more prior to the start of the booking period;
    4. you are not entitled to a refund if you miss your flight or your flight is cancelled;
    5. it is your responsibility to always check the travel requirements for the country, or countries, you intend to visit (or transit) whilst you are away;
    6. it is your responsibility to ensure that you allocate enough time to park your car in order to meet airline check-in and boarding requirements; and
    7. Sydney Airport’s online booking system is a self-service reservation system where it is your responsibility to check, confirm and manage your parking booking.
  4. If you wish to dispute a fee paid by you, please send an email that includes the following information:
    1. Car Park receipt (scanned copy);
    2. The first 6 and last 3 digits ONLY of the credit card that was used to make the purchase;
    3. For Car park Pre-booking; the Booking invoice number;

Without prejudice to any other rights Sydney Airport may have, Sydney Airport reserves the right to apply a $28 administration charge as a contribution towards the cost of processing any claim made by you, unless Sydney Airport accepts that you are entitled to a refund for the fee paid by you, in which case Sydney Airport will not apply an administration charge.

  1. Cancellation is only effective where:
    1. you log in to your Sydney Airport online booking account and successfully cancel your booking.  Your account may be accessed at https://prebook.sydneyairport.com.au/; or
    2. if you are unable to successfully cancel your booking via your online booking account, you notify us by email at book@syd.com.au 24 hours or more prior to the start of the booking period.  Your email must set out your full name, contact number, booking invoice number, booking period and the details as to why you could not log in to your online booking account to complete the cancellation.  Never send credit card details via email. Sydney Airport may in its discretion determine whether to apply a refund.  Refunds are not guaranteed.
  2. Non-refundable fees including but not limiting, credit card fees, booking fees and any other fees notified to you as non-refundable, are non-refundable.
