Terms and Conditions - Hawaiian Airlines Competition

Congratulations to Sydney Airport customer, J.Maric, New South Wales, 2018, for winning a trip for two to Hawaii in the Sydney Airport-Hawaiian Airlines competition.

  1. Information on how to enter and prize form part of these Terms and Conditions. Participation in this Win a trip to Hawaii Promotion (“Promotion”) is deemed acceptance of these Terms and Conditions. All times stipulated in these Terms and Conditions are expressed in Sydney local time.

  2. Subject to condition 3, this Promotion is only open to NSW residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.

  3. The following are ineligible: (i) employees of the Promoter, or any of the tenants or retailers in the Sydney Airport or any of the Promoter’s agencies that are associated with the Promotion; (ii) the spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iii) any person who the Promoter has previously notified is not permitted to enter the Promoter’s promotions.

  4. This Promotion commences at 6:00 am on 1st March 2019 and ends at 9:00 pm on 30th June 2019 (“Promotion Period”).

  5. The Promotion will be conducted at Sydney Airport’s T2 Domestic terminal (“Participating Airport”). “Participating Retailers” means any T2 retailer (including food and specialty retailers) as listed in the Appendix A1. An “Ineligible Transaction” means any transaction recorded on an invalid receipt, as specified in condition 7 below.

  6. To receive an entry in this Promotion, eligible individuals must, during the Promotion Period, undertake the following steps:

a) Spend $50 or more in single transaction during the Promotion Period at any of the Participating Retailers at the Participating Airport, excluding any Ineligible Transaction (“Qualifying Spend”);

b) Upon making a Qualifying Spend, entrants will be issued with a promotional flyer directing them to the promotional website. Individuals must visit the promotional website, follow the prompts to the competition entry page, input the requested details including the retailer of purchase, the value of their purchase and the date of their purchase;

c) Entrants will then be asked to upload a copy of their purchase receipt and will be given the opportunity to “opt in” to receive marketing emails from the Promoter, Hawaiian Airlines and/or Waikiki Beachcomber by Outrigger;

d) Once the receipt has been successfully uploaded, entrants can choose to opt in from the list of service providers and then submit their fully completed online entry form.

Entrants will be awarded one (1) entry for every $50 spent in a single transaction up to a maximum of ten (10) entries for a single transaction (i.e. $500).

  1. The following receipts are not valid receipts for the purpose of the Promotion: (a) receipt(s) from non-participating retailers and Excluded Retailers; (b) receipt(s) recording car park payments and prescription medicine, mobile phone recharge card, lottery ticket and tobacco and tobacco-related product purchases; (c) receipts recording redemption of gift card purchases, store credit, refunds and exchanges; (d) ATM or EFTPOS receipts; (e) credit card or bank statements; and (f) receipts that the Promoter has reasonably determined to have been tampered with or have been obtained fraudulently or are a reprint of the original receipts. The same purchase receipt can only be submitted once in the Promotion. The Promoter reserves the right to stamp and/or photocopy each purchase receipt submitted in the Promotion before returning them.

  2. Multiple entries are permitted, subject to the following: (i) one (1) entry will be awarded per $50 spent in a single transaction up to a maximum of ten (10) entries per person per Qualifying Spend; and (ii) each entry for each Qualifying Spend must be submitted separately and in accordance with the entry requirements.

  3. The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, NSW 2259 at 9:00am on Wednesday, 3rd July 2019. The Promoter reserves the right to draw reserves in case of an invalid entry or invalid entrant.

  4. The provisional winner will be notified by email within two (2) business days of the draw. A provisional winner will only be deemed a winner once verified by the Promoter. The major prize winner will be published online at sydneyairport.com.au on 5th July 2019.

  5. The first valid entry drawn from all valid entries received will win the major prize of a trip for two (2) adults to Hawaii valued at up to AU$6,589.97 depending on date and point of departure. Prize includes:

  • Two (2) x return economy airfares from Sydney, NSW to Honolulu flying Hawaiian Airlines valued at up to AU$3,000; and
  • Six (6) nights’ accommodation at Waikiki Beachcomber Outrigger in a Partial Ocean View Room up to the value of AU$3,589.97.
  1. Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The prize winner and their guests must travel together and share the same itinerary. Seats are subject to availability. Travel dates need to be booked and ticketed by 31st August 2019 and booked through Sydney Reservations between the hours of 9:00am and 5:00pm on 1300 661 339. Entire travel must be completed by 2 April 2020. Travel is NOT permitted during the following periods: 03 July – 21 July 2019, 28 September – 13 October 2019, 27 & 28 November 2019, 13 December 2019 - 18 January 2020, 14 February – 21 February 2020 and 3 April – 30 April 2020. Visitors to the USA will need to apply for a Visa Waiver via the Electronic System for Travel Authorization (ESTA) prior to travelling to the United States. A fee will apply to new ESTA applications and renewals payable by credit or debit card at https://esta.cbp.dhs.gov. The winner and his/her companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner and his/her companion must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. The winner may be required to present their credit card at time of accommodation check in.

  2. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

  3. Total prize pool value is up to AU$6,589.97.

  4. If the prize is unclaimed by 3rd October 2019 it will be entered into the unclaimed prize draw. The unclaimed prize draw will take place at the same time and place as the original draw on the 3rd October 2019, subject to any directions from a regulatory authority. The winner will be notified by email within two (2) business days of the draw. In the event of a winner, their name and postcode published at sydneyairport.com.au commencing on 8th October 2019.

  5. Incomplete, indecipherable or illegible entries will be deemed invalid.

  6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  7. Prize is subject to the standard terms and conditions of individual prize and service providers. If for any reason the winner does not take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.

  8. If the prize (or part of the prize) is unavailable due to reasons beyond the control of the Promoter, the Promoter its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  9. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.

  10. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  12. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority to modify, suspend, terminate or cancel the Promotion, as appropriate.

  13. The Promoter’s decision is final and no correspondence will be entered into.

  14. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and its related bodies corporate (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

  15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and its related bodies corporate (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether received by the Promoter or not) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant or winner; or (f) use of the prize.

  16. It is a condition of taking the prize, that the winner (and where applicable any companions) sign a deed of release and indemnity in the form required by the Promoter or any prize supplier.

  17. The Promoter may need to collect personal information about each claimant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. If the entrant opts in at the time of entry, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in our Privacy Policy. Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored in accordance with the Privacy Policy. Upon the claimant’s request, information provided will be removed from the Promoter’s active marketing database. Information will be removed as soon as reasonably possible in accordance with the Promoter’s Privacy Policy and applicable laws. The Promoter uses third party service providers who hold information on servers based in the United States. All entries remain the property of the Promoter.

  18. The Promoter may share personal information with Hawaiian Airlines and/or Waikiki Beachcomber by Outrigger if the entrant opts in to Hawaiian Airlines and/or Waikiki Beachcomber by Outrigger at the time of entry. Entrants should refer to their individual privacy polices available at https://www.hawaiianairlines.com.au/legal/privacy-policy and https://www.outrigger.com/privacy-policy to see how their personal information will be handled.
