Air Canada & Sydney Airport Giveaway - Terms and Conditions
Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Sydney Airport Corporation (ABN 62 082 578 809) of 10 Arrivals Court Mascot, NSW, 2020, Australia is the promoter of this promotion (“Promoter”).
Entry is only open to residents of New South Wales, Australia aged 18 years and over.
Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entries into the promotion open at 00:01am AEST on 19/05/2025 and close at 11:59pm AEST on 29/06/2025 (“Promotional Period”).
How to enter
To enter, entrants must undertake the following steps during the Promotional Period: (a) visit www.sydneyairport.com.au and follow the prompts to the promotional entry form; (b) input the requested details including full name, mobile number, valid email address and residential postcode; (c) check the box agreeing to these Terms and Conditions; (d) check the box agreeing to receive marketing material from Sydney Airport; (e) submit the fully completed form.
As a condition of entry, entrants have consented to the collection and use of their personal information for the purposes of: (a) the Promoter conducting this promotion as set out in these Terms and Conditions; and (b) receiving marketing material from Sydney Airport, including the Sydney Airport newsletter. Personal information collected through this promotion will be handled in accordance with clauses 34, 35 and 36 below.
Only one (1) entry is permitted per person.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
How the winner will be chosen
Prize
(a) Two (2) return economy flights to Vancouver, Canada for two (2) people with Air Canada (departing from Sydney Airport and arriving at Vancouver International Airport, Canada) valued at up to AUD$7,150 (depending on the date of departure) (the “Promotional Tickets”);
(b) Six (6) nights' accommodation for two (2) people, in one (1) double occupancy room, in Vancouver, Canada valued at up to AUD$2,550 (depending on the date of booking), including:
(c) Two (2) night stay including breakfast for two (2) guests at Pinnacle Hotel Harbourfront (www.pinnacleharbourfronthotel.com);
(d) Two (2) night stay including breakfast for two (2) guests at Fairmont Hotel Vancouver (www.fairmont.com/hotelvancouver); and
(e) Two (2) night stay for two (2) guests including breakfast at Delta Hotels by Marriott Vancouver Downtown Suites (www.marriott.com/marriott.com/YVRDV).
Air Canada and Sydney Airport are not responsible for and will not bear any and all expenses and ancillary costs which may be incurred in the use or redemption of the Prize. Ancillary costs including but not limited to travel insurance, spending money, additional accommodation, meals, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature and in-room charges are not included.
Air Canada and Sydney Airport will not be responsible for any costs due to delay, cancellation or disruption of service. Denied boarding compensation is not applicable.
Travel must be completed before 30/06/2026 and is subject to booking, exclusion periods (see clause 18 below), seat availability, and hotel room availability at time of booking.
Travel must be completed outside of the following exclusion periods: (a) 30/06/2025 – 07/09/2025; (b) 10/12/2025 – 11/01/2026; (c) 28/05/2026 – 12/07/2026 (applicable to Pinnacle Hotel Harbourfront accommodation only); and (d) 18/06/2026 to 30/06/2026.
These exclusion periods may change from time to time. The winner will be notified of any changes to these exclusion periods directly by Air Canada. Once the winner has booked their trip using the Promotional Ticket(s), their booking will not be invalidated by any subsequent change to the exclusion periods set out in this clause.
The winner and their companion must depart from and return to the same departure point and travel together on the same itinerary. Return travel on the Promotional Ticket(s) must be completed within 90 days of outbound travel. Stopovers or multi-city itineraries are not permitted.
Once the Promotional Ticket(s) have been issued, the origin (Sydney Airport, Australia) and destination (Vancouver International Airport, Canada) cannot be changed. However, a change to the flight time and/or travel date may be permitted. A change fee per Promotional Ticket may apply. The quantum of this fee will depend on the value of the fare(s) booked with the Promotional Ticket(s).
The Prize is subject to the Air Canada Conditions of Carriage for International Passengers and Baggage (available at: https://www.aircanada.com/au/en/aco/home/legal/conditions-carriage-tariffs.html#/), as applicable.
The winner and their companion are responsible for obtaining any and all visa requirements and travel insurance for the Prize when necessary and if applicable.
Frequent flyer milage accumulation does not form part of the Prize. The use of eUpgrade credits is not permitted.
Total Prize pool value is up to AUD$9,700 (depending on the date of departure).
All prize values stated in these Terms and Conditions are inclusive of GST where applicable, and expressed in AUD, unless specified otherwise.
If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken, redeemed or upgraded as cash, unless otherwise specified.
The Promotional Ticket(s) may not be distributed or sold, or otherwise used for commercial or personal gain, other than for the purpose for which it is intended.
A draw for the Prize, if unclaimed, may take place on 28/07/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified by email and phone within two (2) business days of the draw.
Any violation of these Terms and Conditions may be subject to cancellation of the Prize and/or to legal action or other recourse available for the recovery of damages suffered or costs, expenses or loss incurred as a result of the violation.
General
In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster or unforeseeable event beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
Subject to clause 25, if for any reason the winner does not take or redeem the Prize by 25/07/2025, then the Prize will be forfeit.
As a condition of accepting the Prize, the winner (and their companion) must sign any legal documentation as and in the form reasonably required by the Promoter and/or prize suppliers, including but not limited to a legal release and indemnity form.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or an entrant; or (f) use / taking of the Prize. All entries become the property of the Promoter.
The laws of New South Wales, Australia apply to this promotion to the exclusion of all other laws. Entrants submit to the exclusive jurisdiction of the courts of New South Wales, Australia. Promotion is void where prohibited.
Use of personal information
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Entrants may withdraw their consent to using their name, likeness, image and/or voice at a future date by contacting Privacy@syd.com.au
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this personal information.
The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at https://www.sydneyairport.com.au/info-sheet/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
