These Terms and Conditions apply to Behind the Scenes Community Tour promotion (”Promotion”).
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions.
Sydney Airport Corporation Limited, ABN 62 082 578 809 (“Sydney Airport”) of 10 Arrivals Court, Mascot, NSW 2020 is the promoter of the Promotion ("Promoter").
Entries into the Promotion open at 12:01AM AEST on 26 May 2025 and close at 11:59PM AEST on 1 August 2025 (“Promotional Period”).
a) who are aged 18 years and over; b) who sign-up and consent to receive the Sydney Airport Community Newsletter and opt-in to enter the Promotion; and c) who are residents of one of the following postcodes within New South Wales, Australia;
("Eligible Entrants").
The Promoter reserves the right, at any time, to verify the validity of entries, including the identity of the entrant (including by requesting further information or documentation which shows, without limitation, an entrant’s identity, age, nationality, state/country of residence). The Promoter reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, fails to provide sufficient information for the Promoter to verify the validity of entry, has tampered with the entry process or engaged in any unlawful or other misconduct calculated to jeopardise fair and proper conduct of the Promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Entries which contain errors or are incomplete or indecipherable, in whole or in part, will be deemed invalid and ineligible.
All entries become the property of the Promoter.
__How the Winners will be chosen __
There will be a total of ten (10) prize draws conducted for the Promotion (each a “Prize Draw”). All Prize Draws will take place at 10 Arrivals Court, Mascot, NSW 2020 on 4 August 2025. Winners will be selected by random chance.
For the avoidance of doubt, each Prize Draw will produce one (1) winner of the Prize (“Winner”).
Within seven (7) days of the Prize Draw:
a) all Winners will be notified by email (using the email address provided to sign-up to the Sydney Airport Community Newsletter); and
b) the names and postcodes of each Winner will be published online at www.sydneyairport.com.au.
12. All Winners have until 18 August 2025 to claim the Prize. If for any reason a Winner does not claim the Prize by that date, then the Prize will be forfeited.
A draw for any unclaimed prizes, if required, will take place on 19 August 2015 at 10 Arrivals Court, Mascot, NSW 2020, subject to any directions from a regulatory authority. Winners will be selected by random chance. The Winners, if any, will be notified by email (using the email address provided to sign-up to the Sydney Airport Community Newsletter) within seven (7) days of the unclaimed prize draw. The names and postcodes of the unclaimed prize Winners will be published online at www.sydneyairport.com.au within seven (7) days of the unclaimed prize draw.
The Promoter’s decision regarding the Prize Draw, and in relation to all other aspects of the Promotion, is final and no correspondence will be entered into.
Winners determined to be Eligible Entrants will be invited to attend a Behind the Scenes Community Tour (“Tour”), which will involve a guided tour of selected areas of the Sydney Airport terminals and/or airfield on 30 August 2025 (“Prize”). The meeting point, commencement time, and duration of the Tour will be included in the Winner notification email.
Each Winner may bring one (1) invited guest to attend the Tour.
For the avoidance of doubt, the Tour will be attended by a maximum of ten (10) Winners and ten (10) invited guests (“Tour Attendees”).
If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal or greater value or specification, subject to any written directions from a regulatory authority.
Prizes are not transferrable or exchangeable and non-cash cannot be redeemed for or taken as cash.
Prior to participating in the Tour, Tour Attendee must sign a media consent form authorising Sydney Airport, and any person it engages, to collect, create, film, produce or reproduce visual, audio and/or digital recordings and/or images of Tour Attendees, their voice, speech and other personal information (“Recordings”).
Tour Attendees acknowledge that Sydney Airport owns the Recordings and may use, edit, exhibit, broadcast or make public the Recordings (or any part of them) anywhere throughout the world in any or all media forever in any manner as it sees fit and authorise or license any third party to do any of these things.
Tour Attendees acknowledge that:
a) Sydney Airport is not obliged to use the Recordings or disclose or publish them in any manner; b)Tour Attendees are not employees of Sydney Airport; c) no feed is payable to Tour Attendees at any time in connection with the Recordings; and d) Tour Attendees have no right of inspection or approval of the Recordings, including their appearance in the Recordings.
Tour Attendees warrant to Sydney Airport that, to the best of their knowledge and belief, their participation in the Recordings does not breach any law, any statements made in the Recordings are true and do not violate anyone’s rights, and they have the unrestricted right to grant the rights and give the consents contained in these Terms and Conditions.
Tour Attendees assign present and future copyright in the Recordings (and any other rights they may have in the Recordings) to Sydney Airport and waive any right to take action that they may have in respect of those rights. Tour Attendees authorise Sydney Airport to use their name, likeness, voice and biographical material in connection with any use of the Recordings.
Tour Attendees release and indemnify Sydney Airport and its respective assignees and licensees from and against all claims relating to the exploitation of the Recordings and any breach of the warranties and the exercise of the rights granted to Sydney Airport by them.
Tour Attendees understand that their consent includes the present and future release of all their theatrical, non-theatrical, video, television, on-line and print performance rights, including fees.
Sydney Airport will handle all personal information in accordance with its privacy policy: https://www.sydneyairport.com.au/info-sheet/privacy. Any questions about how your personal information will be handled should be directed to privacy@syd.com.au.
Prior to participating in the Tour, Tour Attendees must sign an indemnity and release form acknowledging that participating in the Tour raises inherent risks and undertaking to exercise reasonable care to avoid damage to themselves, other persons, Sydney Airport and third-party property and observe all reasonable directions of the representatives of Sydney Airport during the Tour.
Tour Attendees indemnify Sydney Airport, its officers, employees, contractors and agents against any claim arising out of, or in connection with, their failure to observe the obligations in clause 28 when participating in the Tour, except to the extent that the claim arises from fraud, negligence or default by Sydney Airport, its officers, employees, contractors or agents.
Tour Attendees release and discharge Sydney Airport, its officers, employees, contractors and agents from any claim they may have arising from their participation in the Tour, except to the extent that the claim arises from fraud, negligence or default by Sydney Airport, its officers, employees, contractors or agents.
If any dispute arises between the entrant and the Promoter concerning the conduct of the Promotion or claiming a Prize, the Promoter will take reasonable steps to consider the entrant's point of view, taking into account any facts or evidence the entrant puts forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter's decision in connection with all aspects of this promotion is final.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its related entities) is not responsible for and excludes all liability for any personal injury, loss (including loss of opportunity), damage, costs or expenses, whether direct, indirect, special or consequential, arising in any way out of the promotion, including arising out of: (a) any technical difficulties or equipment malfunction; (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or entrant; or (f) the taking of a prize.
The laws of New South Wales, Australia apply to the Promotion to the exclusion of all other laws. Entrants submit to the exclusive jurisdiction of the courts of New South Wales, Australia. Promotion is void where prohibited.
